We at SunFrog take the protection of Intellectual Property ("IP") rights very seriously. SunFrog is a service provider through which a user can open an account and upload designs they claim as their own to offer for sale on t-shirts, sweatshirt hoodies, and other apparel. As we are a service provider, all content on the sunfrog.com platform is user-generated. While some employees may choose to open an account and upload designs on their own time, none of these designs are uploaded by SunFrog employees as part of their job, as a requirement for their job, or as part of their employment duties. Users control the content of the design they upload, the pricing of the design, what options are offered for each design, and which designs they will offer on the SunFrog platform.
As we are dedicated to protecting the IP of others, we have several protections in place. Included in these is that each account holder must attest/swear that they are the owner of any/all designs (and all component parts of any design) they upload, that they are working on behalf of the owner of the IP, or have acquired the right to use the IP from the owner of same. Unfortunately there are users who do not respect such rights. In the age of the internet it is impossible for any one person or organization to know every design that enjoys protection under IP law. We therefore strictly comply with the Digital Millennium Copyright Act ("DMCA"). The DMCA provide a method for owners of protected IP to submit an infringement claim to a service provider such as SunFrog. Once a claim is submitted, the DMCA requires that we respond in certain ways and within certain time-frames.
